1. Definitions
"We", "Us", "Our" — Lumenspar, operating at 84 Jalan Tebrau, 80250 Johor Bahru, Johor, Malaysia.
"You", "Customer", "Owner" — any individual who contacts us, submits an enquiry, or leaves a watch in our care for service.
"Service" — any watch repair, testing, regulation, or restoration work carried out by the workshop, as described on our website and in written service quotations.
"Service Document" — the written record produced for each completed job, describing the work performed and the results of any tests conducted.
"Agreement" — the terms set out here, together with any written quotation or service confirmation we have provided to you.
2. Acceptance of Terms
By submitting an enquiry through our website, contacting us directly, or leaving a watch at the workshop for service, you agree to be bound by these Terms and Conditions.
Our services are available to individuals aged 18 and above who have the legal capacity to enter into a binding agreement under Malaysian law. If you are acting on behalf of another person in relation to their watch, you represent that you have authority to do so.
3. Services
Lumenspar offers three categories of workshop service: water resistance testing and gasket renewal, timing regulation and rate adjustment, and full restoration for heritage timepieces. Full descriptions of each service, including what is included in the scope, are set out on our Solutions page.
Services are available to customers in Malaysia and to customers who are able to bring or send their watches to our Johor Bahru premises. We do not accept watches sent by post unless a specific written arrangement has been made in advance.
We reserve the right to decline a service request if the work required falls outside our current scope, if the piece cannot be safely serviced with our current equipment, or for any other reasonable operational reason. We will advise you of this at the initial assessment stage.
4. Quotations and Staged Approval
All work is carried out against a written or verbally confirmed quotation. No work will begin without your agreement to the quoted scope and price. For standard services (gasket renewal and timing regulation), the quoted price is fixed once agreed, subject to the conditions in Section 5 below.
For heritage restoration work, each stage of the project is quoted and approved separately before that stage commences. You are not committed to any stage you have not explicitly agreed to. The project may be paused or concluded at any point, and you will be charged only for the stages that have been completed or are in progress at the time of any such decision.
Where an assessment reveals that additional work is required beyond what was initially described, we will contact you before proceeding. No additional work will be carried out without your explicit agreement.
5. Payment Terms
All prices are quoted and invoiced in Malaysian Ringgit (MYR). Payment is due upon collection of the watch, or upon notification that the work has been completed and the piece is ready for collection.
We accept payment by cash and bank transfer. Specific payment method options will be confirmed at the time of service.
If a watch is not collected within 60 days of notification that it is ready, we reserve the right to charge a reasonable storage fee. If a watch is not collected within 180 days of notification, we may take steps to recover the cost of the completed service in accordance with Malaysian law.
Quoted prices may be subject to adjustment if the scope of work changes as a result of findings that could not have been reasonably anticipated at the time of the initial quotation, provided that any such adjustment is discussed and agreed with you before additional work proceeds.
6. Customer Responsibilities
You are responsible for ensuring that you have the authority to bring a watch to us for service — whether as owner or as an authorised representative of the owner.
You should provide accurate information about the watch's known history, any previous service, and any symptoms you have observed. This helps us carry out an accurate assessment and propose the appropriate service.
You are responsible for collecting the watch within a reasonable time after being notified that work is complete.
7. Intellectual Property
All content on our website, including text, images, and design, is owned by or licensed to Lumenspar. You may not reproduce, distribute, or use our content without written permission.
Service documents and photographic records produced in relation to your watch are provided to you for your personal reference. The underlying methodology and documentation formats remain the intellectual property of Lumenspar.
8. Disclaimers
We carry out all work with reasonable care and skill. However, we cannot guarantee specific outcomes for all pieces. Vintage and heritage watches may have underlying conditions that become apparent only during disassembly, and not all such conditions can be fully resolved.
Our website is provided for informational purposes. While we aim to keep it accurate and current, we do not warrant that all content is complete or error-free.
Nothing in these Terms limits your rights under Malaysian consumer protection law where those rights cannot be excluded by contract.
9. Limitation of Liability
Our liability to you for any claim arising from the services we provide is limited to the amount you paid for the specific service to which the claim relates. We are not liable for indirect losses, consequential losses, or loss of value attributed to a watch in circumstances beyond our reasonable control.
We maintain care for watches left with us while they are on our premises. We are not responsible for damage caused by pre-existing conditions, by failures that could not be detected at the time of assessment, or by events outside our control.
10. Dispute Resolution and Governing Law
These Terms are governed by the laws of Malaysia. Any dispute arising from our services should first be raised directly with us at [email protected]. We will endeavour to resolve complaints fairly and promptly.
If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of Johor, Malaysia.
Your rights under the Consumer Protection Act 1999 (Malaysia) are not affected by these Terms.
11. Changes to These Terms
We may update these Terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after a change constitutes acceptance of the updated terms.
12. General
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce a provision on any occasion does not constitute a waiver of our right to enforce it on another occasion. These Terms constitute the entire agreement between us regarding the subject matter described here.
